Terms of Service

Welcome to Here2Hire, Australia’s trusted hire marketplace. By using our platform, you agree to the following Terms of Hire, which outline the responsibilities, rights, and obligations of all users—both those hiring out equipment (“Owners”) and those renting equipment (“Hirers”).

  1. Definitions • “Platform”: Here2Hire (website, app, and related services). • “Owner”: The person listing an item or equipment for hire. • “Hirer”: The person renting the item. • “Item” or “Equipment”: Any asset listed for hire (tools, electronics, vehicles, furniture, machinery, etc). • “Hire Period”: The agreed time during which the hire takes place.

  2. User Eligibility • You must be 18 years or older to use Here2Hire. • You must provide accurate personal, payment, and contact details. • By signing up, you agree you’re capable of entering into a legally binding agreement.

  3. Role of Here2Hire • Here2Hire acts only as a marketplace facilitator, connecting Owners and Hirers. • We do not inspect, own, maintain, or guarantee any equipment listed. • Any hire agreement exists between the Owner and the Hirer directly.

  4. Owner Responsibilities Owners must: • Ensure their items are clean, functional, safe, and legally eligible for hire. • Provide honest, clear descriptions and photos. • Deliver items on time or be available for pickup as arranged. • Maintain all legal and safety compliance, including tagging (see Section 10). • Not list unsafe, illegal, stolen, or hazardous items.

  5. Hirer Responsibilities Hirers must: • Inspect all items upon receiving them. • Use them as intended and follow safety guidelines or instructions provided. • Return items on time and in the same condition (excluding reasonable wear and tear). • Report any issues or damage immediately. • Take full responsibility for the item during the Hire Period.

  6. Payments & Fees • Payments are processed securely through the Here2Hire platform. • Service fees apply to both Hirers and Owners. • Owners are paid after the hire is complete, minus fees. • Cancellations or disputes may incur charges per our policies.

  7. Cancellations & Refunds • Cancellations must be processed through the platform. • Refunds follow our Cancellation & Refund Policy. • Owners may have their own cancellation rules if listed clearly on their items.

  8. Damages, Loss, and Liability • Hirers are responsible for any loss or damage during the hire. • Owners must report damage within 24 hours of item return. • Significant damage or non-return may result in charges up to the item’s replacement value. • Here2Hire will assist in dispute resolution but is not liable for damages.

  9. Insurance • We recommend all users (Owners and Hirers) have their own insurance. • Here2Hire does not guarantee coverage at this time. • Users are responsible for any insurance claims.

  10. Electrical, Power Tools & High-Risk Equipment

10.1 Owner Requirements: • All electrical items must be tested and tagged according to Australian standards (e.g. AS/NZS 3760). • High-risk items must be safe, maintained, and come with instructions or a usage briefing.

10.2 Hirer Acknowledgement: • Hirers must only use equipment they’re competent and qualified to operate. • They accept full responsibility for safe use. • If an item seems faulty or unsafe, they must stop using it and report it immediately.

10.3 Platform Disclaimer: • Here2Hire does not inspect or test equipment. • Use of any item is at your own risk. • Liability for faults, injury, or misuse lies with the Owner and Hirer—not Here2Hire.

  1. Prohibited Items You must not list or rent: • Stolen, illegal, or counterfeit goods • Firearms, explosives, or hazardous chemicals • Medical or life-saving equipment • Any item you do not own or maintain

  2. Tax & Income Responsibility • Owners are responsible for reporting and managing any income earned. • Here2Hire holds no responsibility or liability for your tax, GST, or earnings declarations. • Please consult a tax advisor to ensure compliance with the ATO or other financial obligations.

  3. Reporting Unsafe or Misleading Listings • Unsafe or suspicious listings should be reported to Here2Hire. • We may suspend or ban any user who breaches safety or listing guidelines.

  4. Platform Rights • We reserve the right to modify, suspend, or remove any listings or accounts at any time. • Terms of Hire may be updated periodically. Continued use indicates agreement to any changes.

  5. Legal & Liability Limits • Here2Hire is not liable for any loss, damage, injury, or dispute arising from any hire or item listed. • Users agree to indemnify Here2Hire from any claims, damages, or legal issues related to the use of the platform.

  6. Governing Law These Terms are governed by the laws of Australia. Any disputes will be handled by Australian courts with appropriate jurisdiction.
